Waiver

I hereby consent to have my minor child participate in the following activities at Coach Moe Athletics, LLC.

I acknowledge that there are risks involved in participating in this activity and hereby assume all risk of injury, harm, damage or death to my minor in connection with his/her participation in this activity. I, for myself and my minor child, willingly assume the risks associated with participation and accept that there are also risks that may arise due to other participants. I agree that my minor child shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions as conditions for participation in any activity offered by Company.

I agree to release, indemnify, defend and hold Company, its officers, directors, owners, affiliates, successors, assigns and subsidiaries harmless from any loss, expense, liability, claim or injury, including but not limited to attorney’s fees, arising out of my participation in training classes offered by Coach Moe Athletics LLC. Our release, indemnification, defense and hold harmless obligations shall apply regardless of whether said accident, loss, liability, expense, claim or injury is the result of negligence, recklessness, or otherwise, excluding only those incidents resulting directly from Coach Moe Athletics LLC gross negligence or willful misconduct. We understand/agree we will be held financially responsible for all damages to property and/or equipment resulting from participation in the above, and we knowingly and voluntarily agree to assume such responsibility as a condition to the minor child’s participation in the training classes referenced herein.

I acknowledge that I have read this form thoroughly and in its entirety and fully understand that it is a release of liability, and I hereby execute this agreement without coercion. By signing this release, I am waiving any right I have to bring a legal action or claim of any kind against the Company, its officers, directors, owners, affiliates, successors, assigns and subsidiaries as a result of participation of any program through Company. I understand that entry into Coach Moe Athletics LLC training facility and execution of this form constitutes consent for Coach Moe Athletics LLC to use any film, video, or likeness of participants for any purpose whatsoever, without payment to the participant.

The invalidity or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of any other provision of this Agreement, which shall remain in full force and effect.
